BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

                     Section 1 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized and directed to execute Change Order No.
Seven (7), which is attached hereto and incorporated herein by reference, to the Agreement with ATS Construction, for the Town Branch Trail Phase 6, increasing the Contract price by $238,600.00 and raising the total Contract price to $5,224,064.75.

                     Section 2 - That an amount, not to exceed the sum of $238,600.00, is hereby authorized for payment to ATS Construction, from account # 3160-303202-90313, pursuant to the terms of Change Order Seven (7).

                     Section 3 - That this Resolution shall become effective on the date of its passage.
