Summary

Authorization to accept Warrenton Woods Subdiv.’s private streets to public right-of-way, provided the contingencies are met. The Planning Commission unanimously recommended acceptance of the private streets on July 14, 2022. Costs to bring the streets to LFUCG standards will be the responsibility of residents. WHEREAS, CAO Policy 32 provides a procedure for accepting privately owned streets into the public street system; and

                     WHEREAS, it has been requested that the private streets identified as Warrenton Circle, Warrenwood Wynd, Meganwood Circle, Hobclaw Lane, and Honeyhill Lane be accepted as public right-of-way; and

                     WHEREAS, the request has been reviewed by the div.s of the Urban County Government and the request forwarded to the Lexington-Fayette Urban County Planning Commission for review; and

                     WHEREAS, on July 14, 2022, the Planning Commission voted unanimously to approve PLN-FRP-22-00013 (Warrenton Woods Unit 1-A), PLN-FRP-22-00015 (Warrenton Woods Unit 1-B), PLN-FRP-22-00017 (Warrenton Woods Unit 1-C), and PLN-FRP-22-00018 (Warrenton Woods Unit 1-D), which provide for Warrenton Circle, Warrenwood Wynd, Meganwood Circle, Hobclaw Lane, and Honeyhill Lane to be accepted as public right-of-way, contingent upon Council approval of acceptance; the installation of sidewalks along one side of the street system; completion of improvements to bring the streets to an acceptable public street standard; and the recording of final record plats to dedicate the streets as public, to provide for maintenance of existing traffic islands, and to provide for maintenance of stormwater management features, all within one year from the passage of this Resolution; and

                     WHEREAS, pursuant to CAO Policy 32, the recommendation of the Planning Commission has been referred to the Urban County Council; and

                     WHEREAS, the Urban County Council is vested which the discretion to accept a dedication of private streets to the public street system, with or without the conditions recommended by the Planning Commission, as Council deems appropriate in the public interest; and

                     WHEREAS, the Urban County Council agrees with the Planning Commission’s recommendation to accept these private streets into public right-of-way, but does not agree with the condition approved by the Planning Commission which requires the installation of sidewalks along one side of the street system, and therefore, the Urban County Council removes the installation of sidewalks as a condition for acceptance of these private streets; and

                      WHEREAS, CAO Policy 32 provides that all property owners or the homeowner’s association must meet all conditions imposed by the Planning Commission and/or the Urban County Council for acceptance of the private streets into the public street system and further requires that amended final record plats must be signed and submitted within one calendar year from passage to dedicate the streets as public, prior to any acceptance by the Urban County Government becoming effective.

                     NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

Section 1 - That the Urban County Government does hereby express its intent to accept Warrenton Circle, Warrenwood Wynd, Meganwood Circle, Hobclaw Lane, and Honeyhill Lane into the public right-of-way, contingent upon the completion of street improvements to bring the streets to an acceptable public street standard and the recording of amended final record plats to dedicate the streets as public, to provide for maintenance of existing traffic islands, and to provide for maintenance of stormwater management features, all within one year from the passage of this Resolution.

                     Section 2 - That this Resolution shall become effective on the date of its passage.
