WHEREAS a certain 22.35-acre tract of land located within the confines of Fayette County, Kentucky, and further described herein, may contain graves which have been abandoned; and
WHEREAS, Kenneth and Sarah Ramsey as current owners of the property, have requested, pursuant to KRS 381.755(1) and KRS 67A.060, that the Lexington-Fayette Urban County Council issue a resolution authorizing removal and relocation of the subject graves, if any; and
WHEREAS, the abandoned graves shall be relocated at a suitable place at the expense of the property owners as provided by KRS 381.755(4) and pursuant to the procedures set forth by Kentucky Administrative Regulations, 901 KAR 5:090, Section 3.
NOW, THEREFORE, BE IT RESOLVED BY THE LEXINGTON-FAYETTE URBAN COUNTY COUNCIL:
Section 1 - That, pursuant to KRS 381.755 and KRS 67A.060, the Lexington-Fayette Urban County Council hereby orders that graves located on the 22.35-acre tract of land may be removed and relocated at any time after the expiration of sixty (60) days after the first publication of notice of such intended action, the 22.35-acre tracts of land being more particularly described at Exhibit "A", a copy of which i...
