Body
WHEREAS, pursuant to Resolution No. 270-2020, the Lexington-Fayette Urban County Government executed Purchase of Services Agreements with five entities for workforce development services under the Workforce Development Grant Program; and
WHEREAS, if an entity met its required goals after the first year and funds were budgeted, the entity’s Purchase of Services Agreement would automatically renew, pursuant to the terms of the Agreement. Otherwise, a contract amendment would be necessary to continue to the next term; and
WHEREAS, pursuant to Resolution 411-2021, the Lexington-Fayette Urban County Government executed the First Amendment to the Purchase of Services Agreement with Community Action Council of Lexington-Fayette, Bourbon, Harrison, And Nicholas Counties, Inc. to allow the Organization more time to meet its required goals for the first year and to simultaneously begin working on its required goals for the second year; and
WHEREAS, the Community Action Council of Fayette, Bourbon, Harrison, and Nicholas Counties, Inc. was unable to meet its goals by the end of the extended period; and
WHEREAS, acknowledging the COVID-19 pandemic’s toll on job readiness programs and the availability of licensing facilities throughout the Commonwealth, the Urban County Government desires to execute the Second Amendment to the Purchase of Services Agreement to reduce the contract amount for FY 2022 proportionate to the reduction in services.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the preamble set forth following the title to this Resolution be and hereby is incorporated herein as if set out in full.
Section 2 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized to execute the Second Amendment to the Purchase of Services Agreement, which is attached hereto and incorporated herein by reference, with the Community Action Council of Fayette, Bourbon, Harrison, and Nicholas Counties, Inc. for workforce development services, reducing the contract amount for FY 2022 to $20,000.00, proportionate to the reduction in services.
Section 3 - That a total amount, not to exceed $20,000.00, be and hereby is approved for payment to the Community Action Council of Fayette, Bourbon, Harrison, and Nicholas Counties, Inc., from account # 1144-136102-1362-78103, pursuant to the terms of the Second Amendment.
Section 4 - That this Resolution shall become effective upon the date of its passage.
