WHEREAS, Resolution No. 604-2018 authorized the Mayor, on behalf of the Lexington-Fayette Urban County Government, to execute an Agreement with New Life Day Center for the Litter Pickup Services with Panhandler Participation Program; and
WHEREAS, the Agreement with New Life Day Center provides that the Agreement is for an initial two (2) year period, with up to two (2) additional one (1) year terms based on the mutual agreement of the parties; and
WHEREAS, Resolution No. 640-2019 authorized the execution of an Amendment to the Agreement, increasing the contract price and authorizing the payment of an additional sum to New Life Day Center; and
WHEREAS, Resolution No. 230-2021 authorized the execution of a Second Amendment to the Agreement, increasing the contract price and authorizing the first renewal of the Agreement for a one (1) year term beginning September 1, 2020; and
WHEREAS, LFUCG and New Life Day Center mutually desire to execute the second renewal of the Agreement for a one (1) year term beginning September 1, 2021, subject to the terms and conditions of the Agreement, as amended.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized to execute the second renewal of the Agreement with New Life Day Center, for the continuation of the Litter Pickup Services with Panhandler Participation Program.
Section 2 - That an amount, not to exceed the sum of $150,000.00, be and hereby is approved for payment to New Life Day Center, from account #4051 - 313201 - 76101, pursuant to the terms of the Agreement, as amended.
Section 3 - That this Resolution shall become effective on the date of its passage.
