Summary

Authorization for the First Amendment to Grant of Easement with Exeter Newton Land, LLC originally entered into April 1, 2010 with Lexmark International, Inc. regarding “Exhibit 1” more commonly known as 1180 Newtown Pike.  The amendment releases a portion of the permanent easement “Exhibit 2” and adds parcels of land described in “Exhibit 3” to the easement, at a cost of $10. This action is needed for a permanent relocation of a portion of the Legacy Trail due to redevelopment on the current trail site. Funds are Budgeted. (L0895-21) (Burton/Albright)

BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

                     Section 1 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized and directed to accept a permanent forty (40) foot access easement of a portion of 1180 Newtown Pike as described in exhibits 3 and 3A, which are attached hereto and incorporated herein by reference, from Lexmark International Inc., for the relocation of the Legacy Trail.

                     Section 2 - That this Resolution shall become effective on the date of its passage.
