An Ordinance amending the Schematic Landscape Plan portion of Ordinance No. 213-83, the Richmond Rd. Landscape Ordinance, so as to allow a privacy fence along the Richmond Rd. frontage to the properties 3604 through 3672 Green Park Ct. [Council Office, Maynard]

WHEREAS, the tree line along Richmond Road frontage of the properties 3604 through 3672 Green Court Park is being removed by Kentucky Utilities,
WHEREAS, Kentucky Utilities agreed to replace the trees with a privacy fence to act as a buffer for the properties located at 3604 through 3672 Green Park Court,
WHEREAS, the Council finds the installation of the privacy fence by Kentucky Utilities is acceptable to act as a buffer for the properties located at 3604 through 3672 Green Park Court.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That Note 1 of the Richmond Road Landscape Ordinance, Ordinance No. 213-83, prohibiting fences as applied to Sheet 13 of the Schematic Landscape Plan of the Richmond Road Landscape Ordinance, which encompasses 3604 through 3672 Green Park Court, is waived to allow installation of a privacy fence by Kentucky Utilities.
Section 2 - That future appropriate plantings May be allowed along the privacy fence as approved by Kentucky Utilities and the Commonwealth of Kentucky.
Section 3 - That this Ordinance amends only that portion of Ordinance No. 213-83 specifically referred to herein. This Ordinance shall not amend any other provision of Ordinance No. 213-83 for any other property or any other aspect of the Richmond Road Landscape Ordinance.
Section 4 - That the Division of Building Inspection is hereby directed to show this change on the official copy of the Richmond Road Schematic Landscape Plan, Ordinance No. 213-83.
Section 5 - That this Ordinance shall become effective on the date of its passage.
