Summary
Authorization of the Final Environmental Covenant associated with the Newtown Pike Extension Project - Mitigation Area. This Environmental Covenant is consistent with the Environmental Impact Statement (FHWA-KY-EIS-0301-F) filed in June 2007 for the Project. This action is required and is part of the acceptance, transfer and use of the land within the Mitigation Area. The Environmental Covenant ensures future awareness and protection of elevated contaminants contained in the deeper soils on the property purchased within the Mitigation Area. No Budgetary impact. BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized and directed to execute the Environmental Covenant, which is attached hereto and incorporated herein by reference, with the Commonwealth of Kentucky, Transportation Cabinet, related to the Newtown Pike Extension Project, at no cost to the Urban County Government.
Section 2 - That this Resolution shall become effective on the date of its passage.
