Title

An Ordinance amending section 2-516 of the Code of Ordinances to add an eighth member, who shall be a non-voting, ex officio Urban County Council member, to subsection 2-516(1); to remove subsection 2-516(4), which makes a holder of public office ineligible for service as a member of the authority; and to renumber the remaining subsections to be consistent with this change; effective on the date of passage.   [Council Office, Maynard]

BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

                     Section 1 - That Section 2-516 of the Lexington-Fayette Urban County Code of Ordinances be and hereby is amended to read as follows:

Sec. 2-516. - Appointment of members.

(1)                     The authority shall consist of eight (8) members appointed by the mayor. One member of the Urban County Council shall serve as an ex officio, non-voting member of the authority.

(2)                     Pursuant to KRS 154.50-326, the initial terms of its members shall be staggered so that two (2) members are appointed for two (2) years; two (2) members are appointed for three (3) years; and three (3) members are appointed for four (4) years. All subsequent appointments shall be for four (4) year terms. Vacancies shall be for the unexpired term in the manner prescribed for in the original appointment.

(3)                     An authority member may be replaced by the mayor upon a showing to the mayor of that authority member's misconduct, including ineffective service, or upon conviction of a felony.

(4)                     The mayor shall appoint the members and designate the initial term to be served by each member on the authority, subject to the foregoing provisions.

                     Section 2 - That this Ordinance shall become effective on the date of its passage.
