A Resolution accepting the bid of L-M Asphalt Partners, Ltd. d/b/a ATS Construction, in the amount of $799,376.86, for the Avenue of Champions and Euclid Avenue Multimodal Improvements Project, contingent upon approval of the award by the Ky. Transportation Cabinet, and authorizing the Mayor, on behalf of the Urban County Government, to execute an Agreement with L-M Asphalt Partners, Ltd. d/b/a ATS Construction, related to the bid.

BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the bid of L-M Asphalt Partners, Ltd. d/b/a ATS Construction, in the amount of $799,376.86, for the Avenue of Champions and Euclid Avenue Multimodal Improvements Project, be and hereby is accepted and approved as to the specification and amounts set forth in the terms of the bid and Agreement, which are attached hereto and incorporated herein by reference, contingent upon approval of the award by the Kentucky Transportation Cabinet, and the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized to execute the attached Agreement with L-M Asphalt Partners, Ltd. d/b/a ATS Construction, related to the bid.
Section 2 - That an amount, not to exceed the sum of $799,376.86, be and hereby is approved for payment to L-M Asphalt Partners, Ltd. d/b/a ATS Construction, from the following accounts in the following amounts: #3160 - 303202 - 91715 ($600,000.00) and #4003 - 303408 - 92811 ($199,376.86), pursuant to the terms of the bid and Agreement.
Section 3 - That this Resolution shall become effective on the date of its passage.
