Title

An Ordinance amending Article 1 of the Zoning Ordinance to replace the term and definition of “Tenant Home” with the term “Dwelling Unit, Farm Employee” and definition; and to replace the term “Tenant Home” in Articles 8 and 10 of the Zoning Ordinance with the new term as defined. (Urban County Planning Commission) [Div. of Planning, Duncan]

Body

WHEREAS, the Lexington-Fayette Urban County Planning Commission has considered a text amendment to Article 1 of the zoning Ordinance to replace the term and definition of “Tenant Home” with a new term and definition; and to replace the term “Tenant Home” in Article 8 and Article 10 of the Zoning Ordinance with the new term as defined.  Planning Commission did recommend APPROVAL of the Staff Alternative Text by a vote of 10-0; and

WHEREAS, this Council agrees with the recommendation of the Planning Commission; and

WHEREAS, the recommendation form of the Planning Commission is attached hereto and incorporated by reference herein.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

Section 1 - That Article 1 of the Lexington-Fayette Urban County Government Zoning Ordinance is hereby amended by deleting the following term and definition in its entirety:

TENANT HOME - An accessory residence, located in an agricultural zone, occupied by a person other than the owner’s family or the farm manager, engaged full-time in an agricultural use on the property. 

 

                     Section 2 - That Article 1 of the Lexington Fayette Urban County Zoning Ordinance is hereby amended to replace the term “Tenant Home” and the definition as follows:

DWELLING UNIT, FARM EMPLOYEE - Any accessory residence located in an agricultural zone, maintained exclusively for the occupancy of employees and their families, or the owner’s immediate family, in connection with an agricultural use on the property. 

 

 

Section 3 - That Articles 8-1(c)12, 8-2(c)12, 8-3(c)12 and Article 10-12(b) of  the Zoning Ordinance are hereby amended by replacing the term “Tenant Home” with the term “Dwelling Unit, Farm Employee”.

Section 4 - That this Ordinance shall become effective on the date of its passage.
