An Ordinance repealing Article XI of Chapter 2 of the Code of Ordinances; removing the Keep Lexington Beautiful Commission from the collection of littering civil penalties; and providing for the distribution of the funds raised by Keep Lexington Beautiful Commission to the non-profit organization created by the members of the Commission. BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That Article XI of Chapter 2 of the Code of Ordinances be and hereby is repealed in its entirety.
Section 2 - That Section 14-105(e) (2) of the Code of Ordinances be and hereby is amended to read as follows:
(2) Designated uses. Civil fines collected pursuant to this section shall be designated for those div.s or agencies charged with enforcement of the littering Ordinance.
Section 3 - That, upon the creation of a non-profit, non-stock Kentucky Corporation, titled “Keep Lexington Beautiful, Inc.” or similar, by the members of the Keep Lexington Beautiful Commission, all funds raised by the Keep Lexington Beautiful Commission held by the Lexington-Fayette Urban County Government shall be disbursed to the newly created organization, subject to the approval of a Budget amendment.
Section 4 - That this Ordinance shall be effective on the date of its passage.
