Authorization to renew the water franchise Agreement with Kentucky American Water for an additional five (5) year term pursuant to the terms of the franchise Agreement and Ordinance No. 144-15. Kentucky American Water’s franchise Agreement, which expires on or about January 21, 2021, was for an initial term of five (5) years, with the option to renew for up to two (2) additional terms of up to five (5) years each. BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the franchise agreement with Kentucky American Water, be and hereby is renewed for an additional term of five years beyond its current expiration date pursuant to the provisions of Ordinance No. 144-15, and the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized and directed to execute any necessary documents related to the renewal.
Section 2 - That this Resolution shall become effective on the date of its passage.
