BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the bid of Cleary Construction, Inc., in the amount of $3,994,754.00, for the Lansdowne South Trunk Sewer Replacement, for the Division of Water Quality, be and hereby is accepted and approved as to the specifications and amounts set forth in the terms of the bid and Agreement, which are attached hereto and incorporated herein by reference, and the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized to execute the attached Agreement with Cleary Construction, Inc., related to the bid.
Section 2 - That an amount, not to exceed the sum of $3,994,754.00, be and hereby is approved for payment to Cleary Construction, Inc., from account #4003-303408-92811, pursuant to the terms of the bid and the Agreement and contingent upon the approval of a pending Budget amendment.
Section 3 - That this Resolution shall become effective on the date of its pas-sage.
