                     BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

                     Section 1 - That subsection 16-6.2(b) of the Code of Ordinances of the Lexington-Fayette Urban County Government be and hereby is amended to read as follows:

Sec. 16-6.2. - [Pickup of small animal carcasses at veterinarian offices; roll-off refuse containers available to residents upon request; fees.]

(b)                     The Div. of Waste Management will provide a ten-cubic yard size "roll off" refuse collection container upon request for properties within the urban services boundary. The fee for the container shall be ninety dollars ($90.00) per weekday. The fee shall be adjusted each year on July 1 to account for changes in the Consumer Price Index for All Urban Consumers (CPI-U) as reported by the U.S. Department of Labor. Notice of the adjusted fee shall be provided by publication of the adjusted fee on the Urban County Government’s website.

 

 

                     Section 2 - That subsection 16-11(a) of the Code of Ordinances of the Lexington-Fayette Urban County Government be and hereby is amended to read as follows:

Sec. 16-11. - Dumpster collection schedules.

 

(a)                     The Urban County Government shall make a maximum of two (2) collections per week from each establishment having dumpster containers. If a dumpster is blocked by a vehicle or is obstructed in any other way which prohibits access to a dumpster, the Division of Waste Management will return for this collection only if collection schedules allow. If more collections are needed by certain establishments, a service charge shall be made for each additional dumpster container collected. The amount of the charge for each additional dumpster container collected shall be fifty dollars ($50.00) and shall be adjusted each year on July 1 to account for changes in the Consumer Price Index for All Urban Consumers (CPI-U) as reported by the U.S. Department of Labor. Notice of the adjusted fee shall be provided by publication of the adjusted fee on the Urban County Government’s website. No dumpster containers will be collected or emptied by the Urban County Government if its collection equipment is required to pass over a curb. Such containers shall be placed and located as directed by the director of the Div. of Waste Management.

 

                     Section 3 - That subsection 16-10(c) of the Code of Ordinances of the Lexington-Fayette Urban County Government be and hereby is amended to read as follows:

Sec. 16-10. - Refuse collection schedules.

(c) When a violation of subsection (b) has occurred the director, Div. of Waste Management, or his designee shall affix a notice of violation to the front door of the residence or structure, to the roll cart container or other conspicuous place and serve upon the property owner, by personal service or by regular mail to the last known address of the owner of the property as it appears on the current tax assessment roll, or to the owner's designee and to the occupant(s) if readily determinable, a notice describing the violation and listing the date and time of the violation and informing the property owner or his designee and the occupant(s) that a civil fine pursuant to article XII May be assessed if the violation continues or two (2) or more notices of violation have previously been issued to the same owner on the same property within a twelve-month period.

 

                     Section 4 - That this Ordinance shall become effective on the date of its passage.
