Authorization to approve a Resolution authorizing the Lexington-Fayette Urban County Government (LFUCG) to apply for low-interest loans for sanitary projects through the Kentucky Infrastructure Authority (KIA).                      WHEREAS, LFUCG proposes to provide upgraded sanitary sewer service for industrial, institutional, commercial, and residential growth in the LFUCG service area; and

                     WHEREAS, under the terms of Title VI of the Water Quality Act of 1987 (Public Law 100-4) and amendments to KRS 224A, the State is authorized to render financial assistance to eligible project applicants by way of capitalization grants from the U.S. Environmental Protection Agency and State match funds comprising the Federally Assisted Wastewater Revolving Fund (State Revolving Loan Program) established to aid in the construction of wastewater treatment facilities improvements and certain related facilities with consideration for approval to be based on applications submitted through the Kentucky Energy and Environmental Cabinet and the Kentucky Infrastructure Authority; and

                     WHEREAS, the improvements proposed for construction by LFUCG are considered eligible for such loan assistance,                     

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

                     Section 1 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized to execute and submit the Applications, which are attached hereto and incorporated herein by reference, to the Kentucky Infrastructure Authority (KIA), and to provide any additional information requested in connection with the Applications, for low interest State Revolving Fund loans in the following amounts to facilitate the following sanitary sewer related projects: $9,969,585.00 for the Town Branch Commons Phase 1/Midland Avenue Trunk Sewer Replacement Project,  $2,355,600.00 for the Lower Griffin Gate Trunk Sewer Project, and $16,888,634.00 for the Expansion Area Three Sanitary Sewer Infrastructure Project

                     Section 2 - That this Resolution shall become effective on the date of its passage.
