An Ordinance amending Section 17-29(5) of the Lexington-Fayette Urban County Government Code of Ordinances to expand the definition of "Outdoor Cafe" by removing reference to specific zones; amending Sections 17-29.2 and 17-29.5 of the Code to require approval by the Lexington and Fayette County Parking Authority for on-street parking controlled by the Authority; and amending Section 17-29.5 of the Code to clarify that the Administrator may deny, revoke, suspend, modify, or condition an outdoor cafe permit for legitimate health, safety, or general welfare purposes, effective upon passage of Council. BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That Section 17-29(5) of the Code of Ordinances of the Lexington-Fayette Urban County Government be and hereby is amended to read as follows:
(5) Outdoor cafe: The placing, locating, or permitting of the placing or locating of encroachments or other furnishings on adjacent right-of-way, such as sidewalks and on-street parking, or public property, by a business appropriately licensed to operate as an establishment where food and/or other refreshments are served and that possess a valid permit under Sections 17-29 to 17-29.5 of the Code.
