Title

An Ordinance amending Section 2A-18 of the Lexington-Fayette Urban County Government Code of Ordinances, relating to helicopter landings within Business and Industrial zones, to increase the frequency of helicopter landings from three (3) times per calendar month in any one location to thirty (30) times per calendar month in any one location, effective upon passage of Council. BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

                     Section 1 - That Section 2A-18 of the Lexington-Fayette Urban County Government Code of Ordinances be and hereby is amended to read as follows:

Sec. 2A-18. - Exceptions

 

Notwithstanding the provisions of this article to the contrary, helicopters may be landed at locations within business and industrial zones as defined by the Lexington-Fayette Urban County Zoning Ordinance Resolution on a frequency of not more than thirty (30) times per calendar month in any one location, at locations which in the sole discretion of the pilot of the helicopter are safe, by notifying the metropolitan police department and the urban county fire and emergency services division thirty (30) minutes prior to the estimated time of landing that such landing and subsequent takeoff will occur, giving the time and exact location of the landing.

 

Further, notwithstanding the provisions of this article to the contrary, fixed-wing aircraft may land at such places or locations within business and industrial zones of the urban county area as the FAA authorizes; however such authorization must be communicated in writing to the police and fire and emergency services divisions forty-eight (48) hours prior to such landing.

 

Section 2 - That this Ordinance shall become effective on the date of its passage.
