Title
A Resolution requesting that the Mayor negotiate an Agreement with Ky. Utilities Co. related to clear cutting or removing trees in certain areas of Lexington-Fayette County. [Council Office, Maynard]
Body
WHEREAS, the Lexington-Fayette Urban County Council previously adopted Resolution No. 531-2020, which condemned Kentucky Utilities Company's practice of clear cutting trees, demanded reconsideration of the practice, requested that this practice be proportionate to the actual threat, and requested that the Co. enter into meaningful, collaborative, and cooperative dialogue with the Lexington-Fayette Urban County Government to discuss these issues; and
WHEREAS, in some instances the Co. has continued or planned to continue this practice of clear cutting or removing trees from underneath its transmission lines in Lexington-Fayette County, which has resulted in additional concern among impacted residents; and
WHEREAS, the Lexington-Fayette Urban County Government does not currently regulate in a significant manner the trimming, clear cutting or removal of trees other than in public rights-of-way pursuant to Chapter 17C of the Lexington-Fayette Urban County Government Code of Ordinances; and
WHEREAS, as a result of the Co.'s clear cutting and tree removal practices in certain areas of Lexington-Fayette County, the Urban County Council is considering adopting significant regulations related to eliminating or reducing these practices; and
WHEREAS, the Lexington-Fayette Urban County Government would prefer to amicably resolve these issues by entering into an Agreement with the Co. related to these practices.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the above recitals are incorporated herein by reference as if fully stated.
