BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized and directed to execute an Expansion Area Development Exaction Agreement with Anderson-Ramsey, LLC and Providence Business Center, LLC, pursuant to Article 23 of the Zoning Ordinance to provide for prepayment of exaction credits, transfer of exaction credits by Providence Business Center, LLC to Anderson-Ramsey, LLC and deferral and/or transfer of certain exaction credits for system improvements constructed in Expansion Area 3 and adjoining off-site area, a copy of which Agreement is attached hereto and incorporated herein by reference.
Section 2 - That this Resolution shall become effective on the date of its passage.
