Body
WHEREAS, the Lexington-Fayette Urban County Planning Commission has considered text amendments to Article 21 of the Zoning Ordinance to allow as a minor amendment, the reduction of surplus parking spaces depicted on the original development plan; and
WHEREAS, the Planning Commission did hold a public hearing on this proposed text amendment on September 25, 2014; and
WHEREAS, the Planning Commission did recommend APPROVAL of the staff alternative text amendment by a vote of 9-0; and
WHEREAS, this Council agrees with the recommendation of the Planning Commission; and
WHEREAS, the recommendation form of the Planning Commission is attached hereto and incorporated by reference herein.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That Article 21-7(a)(5) of the Zoning Ordinance of the Lexington-Fayette Urban County Government is hereby amended to read as follows:

DEVELOPMENT PLANS

21-7(a) MINOR AMENTMENTS DEFINED
Minor amendments are intended to expedite approval in those situations where amendments are of a minor significance and generally relate to the shifting of previously approved spaces. Such amendments (1) shall not decrease the overall land area in yards or other open spaces; (2) shall not increase building ground area coverage, floor area, or height, or increase the number of dwelling units; ...
