An Ordinance amending Section 7-45 of the Code of Ordinances, which provides for Budget Adjustments for certain Budget Amendment items to add Subsection (I) pertaining to Council Capital Project funding, effective upon passage of Council. [Council Office, Hall]

WHEREAS, it is more efficient and timely to have the option of using an approval process for certain Budgeting actions that does not require an Ordinance for each such action; and
WHEREAS, the Lexington-Fayette Urban County Government has previously adopted legislation in this area that should be unified in the Code of Ordinances of the Lexington-Fayette Urban County Government.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That Section 7-45 of the Lexington-Fayette Urban County Government, Code of Ordinances, be and hereby is amended to add subSection (i), to read as follows:
Sec. 7-45. Exceptions. The following types of amendments May be processed using a Budget adjustment process administered by the Division of Budgeting:

(i) Council Capital Project for Council-approved allocations to any dept. or div
Section 2 - That to the extent any Ordinance or Resolution is in conflict with the provision of this Ordinance, the provisions of this Ordinance shall take precedence.
Section 3 - That if any Section, subSection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unlawful by a court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions hereof.
Section 4 - That this Ordinance shall become effective on the date of its passage.
