Body
WHEREAS Chapter XIII of Code of Ordinances Article 18 authorizes the creation of pedestrian oriented business districts; and whereas the Council finds that the business area comprised of 303, 304, 315, 319, 325, 327, 329-333, 341, 345, 357, 371, 377, 385, and 395 South Limestone is characterized by a predominately pedestrian nature and that the strict application of the minimum off-street parking requirements of the Zoning Ordinance would be detrimental to maintaining the unique character of the area; and whereas the Council had considered the impact of the district on nearby residential areas and finds that creation of the district will not unduly harm the character of such nearby areas; be it ordained by the Council of the Lexington-Fayette Urban County Government:
Section 1 - The Council hereby creates a pedestrian-oriented business district comprised of 303, 304, 315, 319, 325, 327, 329, 329-333, 341, 345, 357, 371, 377, 385, and 395 South Limestone Street, hereby designated and known as the "South Limestone Pedestrian Oriented Business District."
Section 2 - Within the South Limestone Pedestrian District, eighty percent (80%) of the off-street parking requirements contained in the Zoning Ordinance are hereby waived for all non-residential uses; however, the Zoning Ordinance provisions shall remain applicable to residential uses with the district.
Section 3 - Prior to passage of this ordinance the Council has provided written notice to nearby properties as required under Code of Ordinances Article 18-189.
