Summary
Authorization to execute a Memorandum of Understanding (MOU) between the Federal Bureau of Investigation, Department of Veterans Affair and the Lexington-Fayette Urban County Government. The MOU states that while the FBI retains primary jurisdiction on this federal property, the Division of Police would be the primary response agency in “emergency tactical situations” due to the close proximity and response time of the response team. The MOU further states that following consultation with the FBI and U.S. Attorney’s Office, the Division of Police could be notified to request assistance and to take primary response for an investigation. BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized to execute the Memorandum of Understanding, which is attached hereto and incorporated herein by reference, with the Federal Bureau of Investigation, Department of Veterans Affairs, for jurisdiction on federal property.
Section 2 - That this Resolution shall become effective on the date of its passage.
