An Ordinance amending and renumbering Articles 3-13(b), (c), (g), (h), (i), (j), and (k), creating Articles 3-13(l), (m), (n)(1),(2),(3), and (o), amending Articles 8-5(c)(11), 8-5(d)(14), 8-9(c)(10), 8-10(c)(10), 23a-5(c)(9), 23a-5(d)(10), 8-25(d)(7), and 8-25(e)(15), and deleting Article 8-5(d)(15), in order to: revise the allowable occupancy for all Short Term Rentals; restrict the number of dwelling units allowed as Short Term Rentals in Residential zones; further define conditions applicable for Short Term Rentals regulated as conditional uses; and allow Short Term Rentals as an accessory use and conditional use in Corridor Node zones, and providing that the Board of Adjustment may consider up to ten (10) new Conditional Use Permit Applications for Short Term Rentals per month, with an effective date of December 12, or the date of passage, whichever is later. WHEREAS, the Lexington-Fayette Urban County Planning Commission considered at a meeting on November 14, 2024, amendments to the text of Articles 3-13(b), (c), (g), (i), and (j), additional text proposed as Articles 3-13(k), (l), (m)(1),(2), and (3), amendments to Articles 8-5(c)(11), 8-5(d)(14),(15), 8-9(c)(10), 8-10(c)(10), 23A-5(c)(9), 23A-5(d)(10), 8-25(d)(7), and 8-25(e)(15), to further regulate Short Term Rentals in the residential, business, mixed use and industrial zones. The Planning Commission did recommend approval of the modified text amendment by a vote of 5-2; and
WHEREAS, this Council agrees with the recommendation of the Planning Commission; and
WHEREAS, the recommendation of the Planning Commission is attached hereto and incorporated by reference herein.
