A Resolution expressing the intent to accept Maddox Lane as a public street, such acceptance being subject to completion of street improvements to bring Maddox Lane to an acceptable standard and subject to sufficient funds being appropriated for this purpose; and contingent upon recording an amended final record plat to dedicate Maddox Lane as public right-of-way. WHEREAS, the Urban County Council is authorized to approve the acceptance of a privately owned street into the public street system; and
WHEREAS, the Urban County Council recognizes that Maddox Lane, a privately owned street, is in a condition of serious disrepair, and further recognizes that the improvement of the condition of Maddox Lane would promote the public purposes of public safety and the general welfare; and
WHEREAS, the Urban County Council desires to accept Maddox Lane into the public street system, in order to support an expenditure of public funds upon street improvements to repair Maddox Lane to an acceptable standard; and
WHEREAS, the request has previously been reviewed by div.s and dept.s of the Urban County Government, with findings that are consistent with the Council's determination that the acceptance of Maddox Lane for purposes of facilitating the improvement of Maddox Lane to an acceptable standard would promote the interests of public safety and the general welfare; and
WHEREAS, the Urban County Government is willing to accept Maddox Lane into the public street system as public right-of-way, contingent upon Council approval of acceptance; subject to the completion of improvements to bring Maddox Lane to an acceptable standard, and further subject to sufficient funds being appropriated for this purpose; and contingent upon the recording of a final record plat to dedicate Maddox Lane as public right-of-way.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
