NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the Code entitled “Code of Ordinances, Lexington-Fayette Urban County Government” published by CivicPlus/Municode Publishing, consisting of the Lexington-Fayette Urban County Government Charter and Chapters 1 through 27, each inclusive, as well as any appendices to the Code of Ordinances, which is attached hereto and incorporated herein by reference, is adopted.
Section 2 - That the Code entitled “Zoning Ordinance, Lexington-Fayette Urban County Government” published by CivicPlus/Municode Publishing, consisting of Articles 1 through 30, each inclusive, which is attached hereto and incorporated herein by reference, is adopted.
Section 3 - That all codified Ordinances of a general and permanent nature enacted on or before August 28, 2026, and not included in the Codes identified herein or recognized and continued in force by reference therein, are repealed.
Section 4 - That the repeal provided for in Section 3 hereof shall not be construed to revive any Ordinance or part thereof that has been repealed by a subsequent Ordinance that is repealed by this Ordinance.
Section 5 - That unless another penalty is expressly provided, every person convicted of a violation of any provision of the Codes or any Ordinance of the Urban County Government shall be punished by a fine of $5.00. Each action of violation and each day upon which any such violation shall occur shall constitute a separate offense. The penalty provided by this Section, unless another penalty is expressly provided, shall apply to the amendment of any Code Section, whether or not such penalty is reenacted in the amendatory Ordinance. In addition to the penalty prescribed above, the Urban County Government May pursue other remedies including, but not limited to, civil penalties, abatement of nuisances, injunctive relief, and revocation of licenses or permits.
Section 6 - That additions or amendments to the Codes identified herein when passed in such form as to indicate the intention of the Urban County Council to make the same a part of a Code shall be deemed to be incorporated in that Code, so that reference to that Code includes the additions and amendments.
Section 7 - That Ordinances adopted after August 28, 2026, that amend or refer to Ordinances that have been codified in the Codes identified herein shall be construed as if they amend or refer to like provisions of the respective Code.
Section 8 - That this Ordinance shall become effective on the date of its passage.
