WHEREAS, the 2023 Kentucky General Assembly increased the amount of an expenditure for which a local government is not required to legally advertise for bids or go through a formal competitive bid process from $30,000 to $40,000 through revisions to KRS 45A.380 and KRS 424.260; and

                     WHEREAS, the Lexington-Fayette Urban County Government would like to raise the amount of its bids that would require legal advertisement to $40,000, and make other changes to its Procurement Regulations consistent with and with the current operations of the Urban County Government.  

                      NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

                     Section 1 - That the Lexington-Fayette Urban County Government hereby amends the attached “Lexington-Fayette Urban County Government Procurement Regulations” to increase the amount of and expenditure for which the Lexington-Fayette Urban County Government is not required to legally advertise for bids to $40,000, to modify the appeals process for penalized vendors, to provide requirements for using employees or companies that work for the government, and to make changes consistent with the actual current operations of the Urban County Government.

                     Section 2 - That the Lexington-Fayette Urban County Government hereby  approves, adopts, and restates the “Lexington-Fayette Urban County Government Procurement Regulations” (28 pages), which are attached hereto and incorporated herein by reference as if fully stated, to govern all procurement activities of the Lexington-Fayette Urban County Government.

                     Section 3 - That the regulations as amended, approved, adopted and restated herein shall become effective on October 1, 2023.
