This is a request to authorize the Mayor to execute change orders to the contract with Marrillia Design and Construction for the Senior Citizen Senior subject to certain conditions including a requirement that individual change orders do not exceed Twenty Two Thousand Two Hundred Dollars ($22,200) and the cumulative total increase for all change orders pursuant to this resolution does not exceed Two Hundred Twenty Two Thousand Dollars ($222,000)  Funds are budgeted.

BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That in order to ensure the timely completion of the construction of the new Senior Citizen Center, the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized to execute any necessary change orders to the contract with Marrillia Design and Construction for the construction of the New Senior Citizen Center, as long as such change orders meet the criteria provided in this Resolution.
Section 2 -       (a)      All change orders will be reviewed and recommended by the consulting architect (EOP Architects, PSC, or their sub-consultants) and by the Urban County Government's Project Manager, Division of Purchasing, and Commissioner of General Services to assure need, appropriateness and accuracy.  
(b)      The reviews and recommendations will be conducted prior to submittal of such change orders to the Mayor for signature.
(c)      A summary of all change orders executed pursuant to this Resolution shall be furnished to the Urban County Council monthly, unless more frequent reporting is requested.
(d)      Any necessary change orders that do not comply with the criteria provided in this Resolution shall be submitted to the Council for authorization.
Section 3 - The Mayor is authorized to execute any change order resulting in a decrease in cost to the project.  In addition, the Mayor is authorized to execute any change order that meets all of the following conditions:
(a)      No change order shall result in a material change to the scope of the project or the contract;
(b)      No individual change order shall be for an amount exceeding Twenty Two Thousand Dollars ($22,000.00) (0.25% of the original bid amount);
(c)      The cumulative total increase for all change orders executed pursuant to this Resolution does not exceed Two Hundred Twenty Two Thousand Dollars ($222,000.00) (2.5% of the original bid amount);
(d)      Budgeted funds must be available to cover any cost increase resulting from a change order.
      Section 4 - That this Resolution shall become effective on the date of its passage.
