BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

                     Section 1 - That the bid of Constellation NewEnergy - Gas Division, LLC, establishing a price contract for Natural Gas supplied pursuant to Columbia Gas of Kentucky, Inc.’s delivery service tariff, in an amount not to exceed the Natural Gas price at the time of requested delivery based on rates established by the New York Mercantile Exchange (NYMEX) plus $0.00 per dekatherm for a term not to exceed 24 months, for the Divisions of Waste Management and Community Corrections, be and hereby is accepted and approved as to the specifications and amounts set forth in the terms of the bid, which is attached hereto and incorporated herein by reference.

                     Section 2 - That the bid of Constellation Energy Gas Choice, LLC, establishing a price contract for the supply of Natural Gas under the SVGTS tariff (Columbia Gas of Kentucky, Inc.) at multiple Lexington-Fayette Urban County Government Facilities, contingent upon a fixed price not to exceed $4.85 per Mcf for a period of up to 36 months, be and hereby is accepted and approved as to the specifications and amounts set forth in the terms of the bid, which is attached hereto and incorporated herein by reference.

                     Section 3 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, is hereby authorized to execute any documents related to the bids.

                     Section 4 - That this Resolution shall become effective on the date of its passage.
