BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized and directed to execute the Pedestrian Overhead Crossing Agreement and other related Agreements, which are attached hereto and incorporated herein by reference, with R.J. Corman RailRd./Central Kentucky Lines, to allow for the construction of a shared-use bridge for the Town Branch Trail Phase V project, for the Division of Engineering.
Section 2 - That an amount, not to exceed the sum of $73,785.00 in FY 2024 be and hereby is approved for payment to R.J. Corman RailRd./Central Kentucky Lines, from account # 3160-303202-3225-90313, pursuant to the terms of the Pedestrian Overhead Crossing Agreement and other related Agreements and subject to the Budgeting of funds in future fiscal years and a future Budget amendment being processed after the Town Branch Trail Phase V project moves to the construction phase to reallocate the funds into the correct accounting.
Section 3 - This Resolution shall become effective on the date of its passage.
