Authorization to submit application and accept award, if offered, to the Kentucky Justice and Public Safety Cabinet requesting federal funds in the amount of $75,000 for the continuation of the Street Sales Drug Enforcement Project, and to execute Agreement with the Fayette County Commonwealth Attorney’s Office in the amount of $69,000 for FY 2017, subject to availability of sufficient funds in Fiscal Year 2017.  $25,000.00 in local general fund match has been requested in the 2017 General Fund Budget.  Funds for future Budget years are dependent upon availability of grant funds.  Budget amendment is in process for FY17.                      BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

                     Section 1 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized to execute and submit a Grant Application, which is attached hereto and incorporated herein by reference, to the Kentucky Justice and Public Safety Cabinet, and to provide any additional information requested in connection with this Grant Application, and to accept this Grant if the application is approved, which Grant funds are in the amount of $75,000.00 Federal funds, and are for continuation of the Street Sales Drug Enforcement Project, the acceptance of which obligates the Lexington-Fayette Urban County Government for the expenditure of $25,000.00 as a local match.

                     Section 2 - That subject to the provisions of Ordinance No. 22-79, the Mayor is hereby authorized, in his discretion as Chief Executive Officer of the Urban County Government, to transfer the unencumbered balance of any operating or capital account appropriation to another operating or capital account appropriation within the Grant Budget previously established for this Grant.                     

                     Section 3 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized to execute an Agreement, which is attached hereto and incorporated herein by reference, with the Fayette County Commonwealth’s Attorney’s Office, for a full-time prosecutor for the Street Sales Drug Enforcement Project.

                     Section 4 - That an amount, not to exceed the sum of $69,000.00 for FY 2017, be and hereby is approved for payment to the Fayette County Commonwealth’s Attorney’s Office from account #3140-112006-71101, pursuant to the terms of the Agreement.

                     Section 5 - That this Resolution shall become effective on the date of its passage.
