This is a request to execute an Agreed Order with the Environmental & Energy Cabinet to resolve water quality violations associated with the Haley Pike Landfill. Payment of a civil penalty in the amount $35,000 is required; $30,000 of which will be used to connect the Police Canine facility to the sanitary sewer as a supplemental environmental project. Funds are budgeted.

BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government be and hereby is authorized to execute the Agreed Order, which is attached hereto and incorporated herein by reference, to resolve water quality violations at the Haley Pike Landfill.
Section 2 - That payment of a $35,000 civil penalty from the Kentucky Environmental & Energy Cabinet pursuant to the terms of the Agreed Order be and hereby is authorized as follows:
An amount, not to exceed the sum of $5,000.00, be and hereby is approved for payment to the Kentucky Environmental & Energy Cabinet from account # 4121-303102-90316, and an amount, not to exceed the sum of $30,000, be and hereby is approved to be paid from account # 4121-303102-90316 for a project to connect the Division of Police Canine Facility to the sanitary sewer system.
Section 3 - That this Resolution shall become effective on the date of its passage.
