Summary
Authorization to execute a Memorandum of Understanding between LFUCG and two individual property owners, for the replacement of a deteriorating retaining wall located along the south right-of-way of E. Vine Street located behind 219 E. High Street and 227/229 E. High Street and the installation of associated storm water features. Once complete, LFUCG will provide a Quitclaim Deed to the property owners for the retaining wall. At a cost estimated not to exceed $220,000. Funds are Budgeted. (L0118-25)(Albright)

BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized and directed to execute the Memorandum of Understanding, which is attached hereto and incorporated herein by reference, with PS Tate Realty, LLC; Karma C. Bryan Realty, LLC; and LCP Holdings, LLC, for Stormwater Quality Project, for the Department of Environmental Quality and Public Works.
Section 2 - That an amount, not to exceed the estimated sum of $220,000.00, be and hereby is approved for payment to the Contractor selected for the Stormwater Quality Project from account # 1105-313101-3101-71299, pursuant to the terms of the Agreement with the selected Contractor.
Section 3 - This Resolution shall become effective on the date of its passage.
