Summary
Authorization for Release of a Sanitary Sewer Service Agreement between Southland Christian Church and the LFUCG and Sanitary Sewer Collections Facilities Conveyance agreement between the LFUCG, Southland Christian Church’s Jessamine County sanitary sewer facilities, and obligations from LFUCG to the Jessamine-South Elkhorn Water District. WHEREAS, Resolution No. 380-99 authorized the execution of the Sanitary Sewer Service Agreement between the Lexington-Fayette Urban County Government (“LFUCG”) and Southland Christian Church of Lexington, Kentucky, Inc. (“Southland”), to allow temporary connection of Southland’s property, located in Jessamine County, to the LFUCG sewer system; and
WHEREAS, Southland and LFUCG have agreed to convey their entire interest in sanitary sewer collection facilities serving Southland’s property to the Jessamine-South Elkhorn Water District (“JSEWD”), and to transfer all maintenance and operation of those sanitary sewer collection facilities to JSEWD; and
WHEREAS, following the conveyance of the sanitary sewer collection facilities to JSEWD, LFUCG will no longer have any interest in the sanitary sewer collection facilities conveyed to JSEWD, and Southland and LFUCG have agreed to execute the Release of the Sanitary Sewer Service Agreement, releasing LFUCG from any and all obligations under the Sanitary Sewer Service Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized to execute the Release of Sanitary Sewer Service Agreement, which is attached hereto and incorporated herein by reference, releasing the Urban County Government from any further obligation under the Sanitary Sewer Service Agreement with Southland Christian Church of Lexington, Kentucky, Inc.
Section 2 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized to execute the Sanitary Sewer Collection Facilities Conveyance, which is attached hereto and incorporated herein by reference, with Southland Christian Church of Lexington, Kentucky, Inc., conveying sanitary sewer collection facilities and transferring maintenance and operation of those facilities to the Jessamine-South Elkhorn Water District.
Section 3 - That this Resolution shall become effective on the date of its passage.
