An Ordinance expanding and extending Partial Urban Services District #7 for the Urban County Government for the provision of garbage and refuse collection and street cleaning, to include the area defined as certain properties on the following streets: Somersly Pl., Deer Haven Ln., Meeting St., Russell Cave Rd., Newtown Pike, Our Tibbs Trl., Stolen Horse Trc., Wentworth Pl., Lochmere Loop, Lochmere Ct., Old Schoolhouse Ln., and Lochmere Pl. [Dept. of Environmental Quality and Public Works, Holmes]

WHEREAS, pursuant to Section 2.04 of the Charter of the Lexington-Fayette Urban County Government, Resolution No. 568-2014 was enacted by the Urban County Council on October 9, 2014, specifying the intention of the Urban County Government to expand and extend Partial Urban Services District #7; and
WHEREAS, pursuant to Section 2.04 of the Charter of the Lexington-Fayette Urban County Government, Resolution No. 568-2014 was published in the Lexington Herald-Leader; and
WHEREAS, pursuant to KRS 67A.860, certified letters were mailed to property owners to be affected by the expansion and extension of Partial Urban Services District #7, informing them of the proposed expansion and extension and the time and place of a public hearing; and
WHEREAS, pursuant to Section 2.04 of the Charter of the Lexington-Fayette Urban County Government and KRS 67A.860, a public hearing was held on November 11, 2014, to inform and receive the views of all interested persons concerning the expansion and extension of Partial Urban Services District #7.
NOW, THEREFORE, PURSUANT TO SECTION 2.04 OF THE CHARTER OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT AND KRS 67A.150, BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE COUNTY GOVERNMENT:
Section 1 - That Partial Urban Services District #7 for the Lexington-Fayette Urban County Government, for the provision of garbage and refuse collection and street cleaning, be and hereby is expanded and extended to include an area defined as the properties, lots, tracts, and parcels of land within Partial Urban Services District #7:

Section 2 - That the Lexington-Fayette Urban County Government will provide the partial urban services of street cleaning to provide clean, safe streets contributing to traffic safety and garbage and refuse collection to provide for the orderly removal of garbage and refuse from residences and commercial establishments on a timely basis to the area defined as the properties, lots, tracts and parcels of land listed in Section 1 above, on or before the effective date of this Ordinance.
Section 3 - That this Ordinance shall become effective on July 1, 2015.
