NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
WHEREAS the Urban County Council passed the Richmond Road Landscape Plan (Ordinance 213-83) that contain certain landscaping requirements along Richmond Road, and
WHEREAS the Corridors Commission was granted the authority to recommend waivers to existing landscaping plans to the Council in Ordinance No. 137-2009 now contained in the revised Code of Ordinances, Section 2 - 472.
WHEREAS at the March 13, 2012 Corridors Commission meeting after hearing the presentation, the Commission recommended a waiver be granted to 2299, 2349 and 2399 Richmond Road, to the Richmond Road Landscape Plan regarding species of plants, a change of location and arrangements of some of the landscaping and a reconfiguration of the pond.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That 2299, 2349 and 2399 Richmond Road are granted a waiver from the Richmond Road Landscaping plan (Ordinance 213-83) regarding species of plants, a change of location and arrangements of some of the landscaping and a reconfiguration of the pond.
Section 2 - That this Ordinance shall become effective on the date of its passage.
