A Resolution approving the assignment of various Agreements with Waste Services of the Bluegrass, LLC to Republic Services of Ky., LLC, relating to Waste Management Disposal and Transfer Station Operations; and authorizing and directing the Mayor, on behalf of the Urban County Government and the Urban County Government Public Facilities Corporation, to execute any necessary documents related thereto; at no additional cost to the Urban County Government; all subject to and conditioned upon the approval of the Dept. of Environmental Quality and Public Works, the Dept. of Law, and all other approvals necessary to give force and effect to the assignment. BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN
COUNTY GOVERNMENT:
Section 1 - That the assignment of various agreements with Waste Services of the Bluegrass, LLC be and hereby is approved to Republic Services of Kentucky, LLC, relating to Waste Management Disposal and Transfer Station Operations.
Section 2 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government and the Urban County Government Public Facilities Corporation, be and hereby is authorized and directed to execute a Consent to Assignment and the Third Amendment to the Waste Supply and Disposal Agreement, which are attached hereto and incorporated herein by reference, with Waste Services of the Bluegrass, LLC and Republic Services of Kentucky, LLC, and any other necessary documents related to the assignment, at no additional cost to the Urban County Government.
Section 3 - That any approval or authorization provided herein shall be subject to and conditioned upon the approval of the Department of Environmental Quality and Public Works, the Department of Law, and any other approvals necessary to give force and effect to the assignment.
Section 4 - That this Resolution shall become effective on the date of its passage.
