Summary

Authorization to approve an agreement with Cassidian Corporation for the public safety grade 800 MHz digital trunked radio infrastructure with eight (8) channels.  The terms of the agreement include a commitment by Cassidian to accept all FCC fines in the event the Division of Police is not in compliance with the FCC narrowband requirement and waivers are not granted by January 1, 2013.  (L438-12)  (Bastin/Mason)

This is a request to approve an agreement with Cassidian Corporation for the public safety grade 800 MHz digital trunked radio infrastructure with eight (8) channels.  The terms of the agreement include a commitment by Cassidian to accept all FCC fines in the event the Division of Police is not in compliance with the FCC narrowband requirement and waivers are not granted by January 1, 2013.  The cost is $4,762,236.  Funds are budgeted.  The agreement is pending review by the Department of Law.

BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

                     Section 1 - That the bid of Cassidian Communications, Inc., for a Radio System (RFB No. 13-2012), for the Division of Police, be and hereby is accepted and approved as to the specifications and amounts set forth in the terms of the bid and the Purchase Agreement, which are attached hereto and incorporated herein by reference, and the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized to execute the Purchase Agreement with Cassidian Communications, Inc., related to the bid, with payment to Cassidian Communications, Inc., in an amount not to exceed $4,584,290.00 for the Radio System, and additional future payments for maintenance and warranty services.

                     Section 2 - That an amount, not to exceed the sum of $4,584,290.00, be and hereby is approved for payment to Cassidian Communications, Inc., from account #2601-505601-95601 ($3,584,290.00) and account #4204-505601-95601 ($1,000,000.00), pursuant to the terms of the bid and the agreement.

                     Section 3 - That this Resolution shall become effective on the date of its passage.
