General Assembly reconsider efforts to remove licensing and mandatory training requirements related to the concealed carrying of weapons; and further requesting that the Ky. General Assembly retain criminal penalties for all violations of the concealed carry laws and regulations of the Commonwealth of Ky. [Council Office, Maynard]

Summary

Body

WHEREAS, an average of approximately 100,000 people are shot each year in the United States; and

WHEREAS, over 18,000 American children and teens are injured or killed each year due to gun violence.; and

WHEREAS, in 2014, Kentucky had the 15th highest number of gun deaths per capita among the states with 627 deaths attributed to gunshot wounds; and                      WHEREAS, since the enactment of the 1994 Brady Handgun Violence Prevention Act (Brady Law) through December 31, 2012, background checks have blocked more than 2.4 million prohibited purchasers nationwide (i.e. domestic abusers, convicted felons, mentally ill persons, and other dangerous individuals) from purchasing a Firearm or receiving a permit to purchase or carry a Firearm; and

WHEREAS, pursuant to KRS 237.110, the Department of Kentucky State Police is currently authorized to issue and renew licenses to carry concealed Firearms or other deadly weapons, or a combination thereof, to qualified persons; and

WHEREAS, the Kentucky Carrying Concealed Deadly Weapons (CCDW) licensure requirements, including the successful completion of safety and training courses, are necessary public safety protections.

                     NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

                     Section 1 - That the above recitals are incorporated herein as if fully stated.

                     Section 2 - That the Urban County Council of the Lexington-Fayette Urban County Government hereby encourages the Kentucky General Assembly to disapprove Senate Bill (SB) 7, which proposes an amendment to KRS 527.020 to allow persons not otherwise prohibited by other laws to carry concealed weapons without a license; requests that the Kentucky General Assembly reconsider efforts to remove licensing and mandatory training requirements related to the carrying of concealed weapons; and further requests that the Kentucky General Assembly retain criminal penalties for all violations of the concealed carry laws and regulations of the Commonwealth of Kentucky.

                     Section 3 - That the Clerk of the Urban County Council is hereby authorized and directed to send a copy of this Resolution to the President Pro-Temp of the Kentucky State Senate; the Speaker of the Kentucky State House of Representatives; the following state Representatives: Russ Meyer (District 39), Stan Lee (District 45), James Kay (District 56), Phillip Pratt (District 62), Sannie Overly (District 72), Kelly Flood (District 75), Ruth Ann Palumbo (District 76), George Brown, Jr. (District 77), Susan Westrom (District 79), and Robert Benvenuti III (District 88); and the following state Senators: Alice Forgy Kerr (District 12), Reginald Thomas (District 13), Tom Buford (District 22), Ralph Alvarado (District 28), and Jared Carpenter (District 34).

Section 4 - That this Resolution shall become effective on the date of its passage.
