WHEREAS, the Lexington-Fayette Urban County Planning Commission has considered a text amendment to create Article 6-8(l)(5) of the Land Subdiv. Regulations to require developers to install a permanent sign denoting “End of Public Maintenance” at each location where a private street intersects or otherwise abuts a public street. The Planning Commission recommended APPROVAL of the text by a vote of 9-0; and
WHEREAS, this Council agrees with the recommendation of the Planning Commission; and
WHEREAS, the recommendation form of the Planning Commission is attached hereto and incorporated by reference herein.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That Article 6-8(l) of the Land Subdiv. Regulations of the Lexington-Fayette Urban County Government is hereby amended to add subsection (5) as follows:
(5) DEMARCATION OF END OF PUBLIC RIGHT-OF-WAY - The developer shall be required to install a permanent sign denoting End of Public Maintenance at each location where a private street intersects or otherwise abuts a public street. Such sign shall conform to design and material standards prescribed by the Division of Traffic Engineering.
Section 2 - That this Ordinance shall become effective on the date of its passage.
