Summary

Authorization to amend the LFUCG Procurement Regulations to increase the amount of an expenditure for which the government is not required to legally advertise for bids from $40,000 to $50,000, to increase the lowest dollar threshold amount from $2,500 to $5,000 and to make changes consistent with the actual current operations of the government; and approving, adopting and restating the regulations to be effective as amended on July 1, 2026. WHEREAS, the 2026 Kentucky General Assembly increased the amount of an expenditure for which a local government is not required to legally advertise for bids or go through a formal competitive bid process from $40,000 to $50,000 through revisions to KRS 45A.380 and KRS 424.260; and

                     WHEREAS, the Lexington-Fayette Urban County Government would like to raise the amount of its bids that would require legal advertisement to $50,000 and make other changes to its Procurement Regulations consistent with and with the current operations of the Urban County Government.  

                      NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

                     Section 1 - That the Lexington-Fayette Urban County Government hereby amends the attached “Lexington-Fayette Urban County Government Procurement Regulations” to increase the amount of and expenditure for which the Lexington-Fayette Urban County Government is not required to legally advertise for bids to $50,000, to increase lower threshold amount requirements, and to make changes consistent with the actual current operations of the Urban County Government.

                     Section 2 - That the Lexington-Fayette Urban County Government hereby approves, adopts, and restates the “Lexington-Fayette Urban County Government Procurement Regulations”, which are attached hereto and incorporated herein by reference as if fully stated, to govern all procurement activities of the Lexington-Fayette Urban County Government.

                     Section 3 - That this Resolution and the regulations as amended, approved, adopted and restated herein shall become effective on the date of its passage.
