An Ordinance expanding and extending Partial Urban Services District #4 for the Urban County Government for the provision of street lighting, to include the area defined as certain properties on Higbee Mill Rd. [Dept. of Environmental Quality and Public Works, Albright]

WHEREAS, pursuant to Section 2.04 of the Charter of the Lexington-Fayette Urban County Government, Resolution No. 500-2024 was enacted by the Urban County Council on October 10, 2024, specifying the intention of the Urban County Government to expand and extend Partial Urban Services District #4; and
WHEREAS, pursuant to Section 2.04 of the Charter of the Lexington-Fayette Urban County Government, Resolution No. 500-2024 was published in the Lexington Herald-Leader; and
WHEREAS, pursuant to KRS 67A.860, certified letters were mailed to property owners to be affected by the expansion and extension of Partial Urban Services District #4, informing them of the proposed expansion and extension and the time and place of a public hearing; and
WHEREAS, pursuant to Section 2.04 of the Charter of the Lexington-Fayette Urban County Government and KRS 67A.860, a public hearing was held on November 12, 2024, to inform and receive the views of all interested persons concerning the expansion and extension of Partial Urban Services District #4.
NOW, THEREFORE, PURSUANT TO SECTION 2.04 OF THE CHARTER OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT AND KRS 67A.150, BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE COUNTY GOVERNMENT:
SECTION 1 - That Partial Urban Services District #4 for the Lexington-Fayette Urban County Government, for the provision of street lighting, be and hereby is expanded and extended to include an area defined as the following properties, lots, tracts, and parcels of land within Partial Urban Services District #4:

SECTION 2 - That the Lexington-Fayette Urban County Government will provide the partial urban service of street lighting in order to provide well-lit, safe streets to deter crime and to contribute to traffic safety to the area defined as the properties, lots, tracts, and parcels of land listed in Section 1 above, on or before the effective date of this Ordinance.
SECTION 3 - That this Ordinance shall become effective on July 1, 2025.
