Title

BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

                     Section 1 - That the title to Article XLIII of Chapter 2 of the Code of Ordinances be and hereby is amended to read as follows:

                     ARTICLE XLIII. ACCESS LEXINGTON COMMISSION

                     Section 2 - That Section 2-457 of the Code of Ordinances be and hereby is amended to read as follows:

                     Sec. 2-457. Created.

A commission is hereby created which shall be known as the “Access Lexington Commission”.

                     Section 3 - That Section 2-458 of the Code of Ordinances be and hereby is amended to read as follows:

                     Sec. 2-458. Membership.

(a)                     The commission shall consist of nineteen (19) members, which shall be appointed by the Mayor, subject to confirmation by the Council.

(b)                     The nineteen (19) members shall be representatives of the following:

(1)                     Two (2) ex-officio members from the Lexington-Fayette Urban County Council;

(2)                     Four (4) members from organizations or individuals representing people with specific disabilities;

(3)                     One (1) member representing the business community;

(4)                     One (1) member representing a regional college or university;

(5)                     One (1) member representing rehabilitation professionals;

(6)                     One (1) member representing a public transportation agency;

(7)                     Two (2) members from employment and/or education advocacy organizations;

(8)                     Two (2) members from the community at large;

(9)                     One (1) ex-officio member shall be the ADA coordinator for LFUCG, or their designee;

(10)                     One (1) ex-officio member shall be the Director of Building Inspection, or their designee;

(11)                     One (1) ex-officio member shall be the Commissioner of Social Services, or their designee;

(12)                     One (1) ex-officio member shall be the Commissioner of Public Safety, or their designee; and

(13)                     One (1) ex-officio member shall be either the Commissioner of Environmental Quality and Public Works or the Director of the Division of Planning, or their designee.

Section 4 - That Section 2-459 of the Code of Ordinances be and hereby is amended to read as follows:

Sec. 2-459. Term.

The members of the commission, other than ex-officio members, shall serve a term of four (4) years from the date of appointment, provided the terms of those originally appointed shall be staggered as provided in Section 7.02 of the Charter. Vacancies shall be filled for the unexpired term in the manner prescribed for the original appointment. Any member May be reappointed for additional terms. The membership of the ex-officio members shall be deemed to have terminated upon their leaving office or employment.

                     Section 5 - That Section 2-463 of the Code of Ordinances be and hereby is amended to read as follows:

                     Section 2-463. Duties and functions of the commission.

The commission shall:

(a)                     Advise the Mayor and the Council on issues of access, representation, employment, housing and quality of life affecting people with disabilities and their families.

(b)                     Serve as a resource for people with disabilities and their families to express concerns and solutions regarding issues affecting them.

(c)                     Publicize the role of the commission for people with disabilities and the resources available to assist people with disabilities, employers, housing representatives, business owners, engineers and architects, and others who have a role in bettering the life of Lexington-Fayette County residents.

(d)                     Promote awareness to the general public of the capabilities, needs and desires of people with disabilities.

(e)                     Publicly recognize the efforts of employers, businesses, schools, organizations, individuals, and others who have demonstrated outstanding support of Programs and services for people with disabilities.

(f)                     Serve as advocate for accessibility issues and implementation of plans and projects to improve services for people with disabilities.

(g)                     Advise urban county dept.s and div.s on policy matters which affect the daily lives of people with disabilities, especially with regard to public facilities.

Section 6 - That this Ordinance shall become effective on the date of its passage.
