BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

                     Section 1 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized and directed to accept $3,000,000 in Federal funds from the Department of Housing and Urban Development (HUD) as an Economic Development Initiative/Community Project Funding (CPF) award for the William Wells Brown Land Acquisition and Construction Project, the acceptance of which does not obligate the Urban County Government to the expenditure of funds.

                     Section 2 - That the Mayor is hereby authorized and directed to execute an Agreement, and any necessary Amendments thereto, the final form which shall be subject to the approval of HUD and the Department of Law, with Community Action Council for Lexington-Fayette, Bourbon, Harrison and Nicholas Counties, Inc., in order to subaward these funds.

                     Section 3 -- That subject to the provisions of Section 7-48 of the Lexington-Fayette Urban County Government Code of Ordinances, the Mayor is hereby authorized, in her discretion as Chief Executive Officer of the Urban County Government, to transfer the unencumbered balance of any operating or capital account appropriation to another operating or capital account appropriation within the Grant Budget previously established for this Grant.

                     Section 4 -- That this Resolution shall become effective on the date of its passage.
