Summary

Authorization to amend the Code of Ordinances, Chapter 2-315(2) - Lexington Children’s Museum Inc., to allow directors of the board to serve three (3) consecutive terms. BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

Section 1 - That Section 2-316(2) of the Code of Ordinances of the Lexington-Fayette Urban County Government be and hereby is amended to read as follows:

….

(2)   All directors of the corporation shall serve four (4) years from the date of appointment, provided that the terms shall be staggered in the manner required by Section 7.02 of the Urban County Charter. Vacancies shall be filled for the unexpired terms in the manner prescribed for the original appointment. Any director May be reappointed for additional terms. However, no director May serve more than three (3) consecutive full terms until the lapse of twelve (12) months from the end of said consecutive terms.

                     Section 2 - That, notwithstanding the general term limit restriction contained in Section 4.107(3) of the Council Rules (commonly referred to as the “Fernita Rule”), this amendment shall control for the purposes of membership to Lexington Children’s Museum, Inc.

Section 3 - That this Ordinance shall become effective on the date of its passage.
