Summary

Authorization to amend Section 21-5 and Section 22-5 of the Code of Ordinances, creating a new Department, reorganizing certain Departments and Divisions and transferring various positions and incumbents within LFUCG.   (L237-12) (Jarvis/Moloney)

This is a request to amend Section 21-5 and Section 22-5 of the Code of Ordinances, creating a new Department of Planning, Preservation and Development, transferring the Divisions of Planning, Historic Preservation and Purchasing of Development Rights from the Office of the C.A.O. to the Department of Planning, Preservation and Development and transferring selected positions and incumbents. The budgetary impact is neutral.

WHEREAS, Section 3.02(24) of the Charter of the Lexington-Fayette Urban County Government provides that the Council shall have the power to “create, alter or abolish departments . . . and to confer upon same necessary and appropriate authority for carrying out all powers and duties assigned thereto;”

                     WHEREAS, Section 6.12 of the Charter of the Lexington-Fayette Urban County Government provides that the Council shall have the power to “consolidate, divide, and otherwise restructure the organization of all departments, offices and divisions covered by Article 6 of the Charter.

                     WHEREAS, it has been determined that effective and efficient operation of government will occur by creating a new department and transferring certain divisions and employees to the new department.

                     NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:

                     Section 1 - That the Department of Planning, Preservation and Development be and hereby is created;

Section 2 - That the Divisions of Planning, Historic Preservation and Purchase of Development Rights and the incumbents in all authorized positions as well as all vacant positions, be and hereby are transferred from the Office of the Chief Administrative Officer to the Department of Planning, Preservation and Development, at their current job classification, pay grade and salary, except as otherwise set forth herein;

Section 3 - That subsection line number 590.115 of Section 21-5(2) of the Code of Ordinances be and hereby is deleted.

                     Section 4 - That the following subsection line numbers of Section 21-5(2) of the Code of Ordinances be and hereby are amended to read as follows:

                     Section 7 - That the follow employees be and hereby are transferred as follows:

A.                     James Hume, Pam Brown, Greg Walker, Robert Phelps, David Jarman, Arbia Adams and Christine Wu be and hereby are transferred at their current job classification, pay grade and salary from the Department of Public Safety, Division of Building Inspection to the Department of Planning, Preservation, and Development, Division of Planning.

B.                     That Derek Paulsen and hereby are transferred at his current job classification, pay grade and salary from the Office of the Chief Administrative Officer to the Department of Planning, Preservation and Development

Section 8 - That certain of the Budgets of the Lexington-Fayette Urban County Government are amended and funds are ap-propriated pursuant to Budget Schedule No. 60, which is attached hereto and incorporated herein by reference.

Section 9 - That this Ordinance shall become effective upon passage.
