BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized and directed to execute the Line Extension Agreement, which is attached hereto and incorporated herein by reference, with Columbia Gas of Kentucky, Inc., for the installation of natural gas service for the Legacy Business Park.
Section 2 - That an amount of $433,278.98, to be used as a refundable deposit, be and hereby is approved for payment to Columbia Gas of Kentucky, Inc., from account # 1105-136103-0001-90319, pursuant to the terms of the Line Extension Agreement, with additional funds approved as payment as required by the Line Extension Agreement, contingent upon the Budgeting of sufficient funds.
Section 3 - That repayment of any deposit funds by Columbia Gas of Kentucky Inc. pursuant to the Line Extension Agreement be and hereby is accepted.
Section 4 - This Resolution shall become effective on the date of its passage.
