An Ordinance extending the term of the non-exclusive telecommunications (or related non-cable) franchise created pursuant to Ordinance No. 69-2016, as provided by the terms of Ordinance No. 69-2016, for an additional one year to provide the Lexington-Fayette Urban County Government additional time to establish a new franchise; extending the term of existing Telecommunications Franchise Agreements for an additional one year from the effective date of this Ordinance; and authorizing the Mayor, on behalf of the Urban County Government, to execute any necessary documents related thereto; all effective upon passage of Council. WHEREAS, for the past year, the Lexington-Fayette Urban County Government has been working with telecommunications and cable companies on the drafting of a new communications franchise;
WHEREAS, the communications franchise is not currently complete and has not been created or established by the Lexington-Fayette Urban County Government;
WHEREAS, the existing telecommunications (or related non-cable) franchise created by Ordinance No. 69-2016 expires on or about June 22, 2026.
WHEREAS, Ordinance No. 69-2016 provides for the extension or renewal of a franchise past the original ten-year period;
WHEREAS, at least one telecommunications Co. has approached the Lexington-Fayette Urban County Government requesting a year extension on the current franchise; and
WHEREAS, the Lexington-Fayette Urban County Government wishes to extend the term of the existing telecommunications (or related non-cable) franchise for a period of one year to allow for further discussion and the establishment of a potential communications franchise or a new telecommunications (or related non-cable) franchise.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That the above recitals are incorporated herein as if fully stated.
Section 2 - That the term of the telecommunications (or related non-cable) franchise created and established by Ordinance No. 69-2016 be and hereby is extended for a period of one year from the effective date of this Ordinance.
Section 3 - That the term of existing telecommunications (or related non-cable) franchise Agreements executed pursuant to Ordinance No. 69-2016 be and hereby is extended for a period of one year from the effective date of this Ordinance.
Section 4 - That, apart from the extension of the term, the terms and conditions of said franchise, and any franchise Agreement executed with a utility pursuant to the Ordinance No. 69-2016, shall remain unchanged.
Section 5 - That the Mayor, on behalf of the Urban County Government, be and hereby is authorized to execute any necessary documents related to the extension of the term of the existing telecommunications (or related non-cable) franchise.
Section 6 - That this Ordinance shall become effective on the date of its passage.
