Body
WHEREAS, by Resolution No. 176-2021, the Urban County Council expressed support for the rehabilitation of the former Palmer Pharmacy Building as a Waypoint Center designed to offer education-based initiatives and Programs to combat poverty; and
WHEREAS, by Resolution No. 605-2021, the Urban County Council authorized a redevelopment Agreement with United Way of the Bluegrass for the renovation and adaptive reuse of the former Palmer Pharmacy Building as a Waypoint Center; and
WHEREAS, by Resolution No. 68-2023, the Urban County Council authorized the execution of a deed and any other documents necessary to transfer the former Palmer Pharmacy Building to United Way of the Bluegrass, subject to deed restrictions in favor of LFUCG for a period of not less than ten (10) years that require that the building be utilized, managed, and repurposed for the general benefit of the community as a Waypoint Center for the provision of health and human services Programming; and
WHEREAS, the Urban County Council desires to allocate Council Capital Project Expenditure Funds for a one-time capital project for elevator construction at the former Palmer Pharmacy Building, in order to facilitate its use as a Waypoint Center for the general benefit of the community in the provision of health and human services Programming.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE LEXINGTON-FAYETTE URBAN COUNTY GOVERNMENT:
Section 1 - That, for the reasons set forth hereinabove, which are incorporated herein by reference, this project meets the criteria of the Council Capital Project Expenditure Policy and will be sponsored and overseen by the LFUCG Department of Social Services.
Section 2 - That the Mayor, on behalf of the Lexington-Fayette Urban County Government, be and hereby is authorized and directed to execute an Agreement related to Council Capital Project Expenditure Funds, which is attached hereto and incorporated herein by reference, with United Way of the Bluegrass, for the Office of the Urban County Council.
Section 3 - That the Urban County Council hereby waives the policy guidelines in Appendix A, Supplement C, Section 2 of the Rules and Procedures of the Lexington-Fayette Urban County Council (Council Capital Expenditure Policy), as recently amended, in order to Grant the Council Capital Project Funds as set forth herein, subject to the terms and conditions of the Agreement.
Section 4 - That an amount, not to exceed the sum stated, be and hereby is approved for payment to United Way of the Bluegrass ($40,500.00), from account #1105 - 121002 - 91715, from various Council Districts, pursuant to the terms of the Agreement.
Section 5 - That this Resolution shall become effective on the date of its passage.
